These Terms and Conditions apply to tickets and attendance at Glowing Pumpkins, operated by Pumpkins Global LLC.
By purchasing, accepting, possessing, or using a ticket to Glowing Pumpkins, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. You also agree to communicate these terms to every person for whom you purchase or provide a ticket.
If you do not agree to these terms, do not complete your purchase or enter the event.
ALL TICKET SALES ARE FINAL. NO REFUNDS WILL BE ISSUED.
This no-refund policy applies to all circumstances, including but not limited to:
Before the ticket’s scheduled date and admission time, eligible tickets may be rescheduled through the ticketing platform’s self-service tools, subject to availability and any applicable ticketing restrictions.
After the scheduled ticket date or admission time has passed, a rescheduling request may be considered on a case-by-case basis. Approval is not guaranteed and is subject to availability.
A request for rescheduling does not entitle the ticket holder to a refund, credit, or replacement ticket.
Tickets have no cash value and may not be redeemed for cash. Unauthorized resale, duplication, or fraudulent use may result in cancellation without a refund.
If Glowing Pumpkins cancels or materially changes an event, any available remedy, including rescheduling or ticket credit, will be determined and communicated by Glowing Pumpkins.
Glowing Pumpkins reserves the right to refuse admission or remove any person from the property or event without a refund when necessary to protect guests, staff, performers, vendors, equipment, displays, or property.
Guests must follow all posted signs and all instructions given by staff and security personnel.
The following are prohibited:
Guests who violate these rules may be removed immediately without a refund and may be held financially responsible for any damage they cause.
Glowing Pumpkins is an outdoor, nighttime walking event featuring illuminated pumpkin displays, themed installations, lighting effects, music, décor, food and beverage vendors, and other family entertainment.
By attending, you knowingly and voluntarily accept the inherent and reasonably foreseeable risks associated with an outdoor nighttime event.
These risks include, but are not limited to:
Serious injury, illness, property damage, disability, or death may occur.
Guests are responsible for remaining alert, watching where they are walking, supervising children in their care, and following all instructions provided by event staff.
Glowing Pumpkins is a family-friendly event, but parents and guardians remain responsible for the supervision and safety of children in their care at all times.
Children should remain with their parent, guardian, or responsible adult throughout the event.
Parents and guardians are responsible for determining whether individual attractions, displays, lighting effects, sounds, walking distances, food products, and activities are appropriate for their children.
Children may not climb on displays, cross barriers, enter restricted areas, or handle event equipment or decorations.
A parent or legal guardian who purchases, provides, or authorizes the use of a ticket for a minor acknowledges the event’s risks and agrees to these terms on the parent’s or guardian’s own behalf and, to the fullest extent permitted by law, on behalf of the minor.
Glowing Pumpkins involves walking through an outdoor nighttime environment.
Guests should consider their own physical condition and mobility before attending.
The experience may include:
Guests using wheelchairs, walkers, strollers, mobility devices, or other assistance equipment should be prepared for changing outdoor surfaces.
Guests are responsible for determining whether they and members of their group are able to safely participate.
Glowing Pumpkins does not provide medical advice or determine whether attendance is appropriate for a particular guest.
Staff may deny access to a specific area or activity if staff reasonably believes participation would create an immediate safety risk.
Food and beverages may be sold or distributed by independent vendors or third parties.
Guests with food allergies, dietary restrictions, or medical concerns are responsible for speaking directly with the applicable vendor before purchasing or consuming any food or beverage.
Pumpkins Global LLC does not guarantee that food or beverage items are free from allergens, cross-contact, or specific ingredients unless expressly stated by the applicable vendor.
Guests are responsible for monitoring children in their care with respect to food, drinks, allergens, choking hazards, and dietary restrictions.
To the fullest extent permitted by Arizona law, you, on behalf of yourself and your heirs, representatives, estate, and assigns, release and discharge the following parties from claims arising from or relating to your attendance, presence on the property, or participation in Glowing Pumpkins:
This release includes claims for personal injury, illness, emotional distress, death, property loss, or property damage arising from the inherent risks of the event or the ordinary negligence of a released party, to the fullest extent permitted by law.
Nothing in these terms is intended to waive any right or liability that cannot legally be waived under Arizona law.
You accept responsibility for injuries, losses, costs, or property damage caused by your intentional, reckless, unlawful, or negligent conduct.
To the fullest extent permitted by law, you agree to indemnify and hold harmless the released parties from third-party claims, damages, expenses, and reasonable attorney fees resulting from:
The ticket purchaser is responsible for providing these Terms and Conditions to every person who receives or uses a ticket from the purchaser.
By purchasing tickets for minors or other members of a group, the purchaser agrees to communicate all event rules, health considerations, refund restrictions, and risk disclosures to the ticket users.
Each adult ticket user independently accepts these terms by accepting or using the ticket or entering the event.
Photography, video recording, and audio recording may occur throughout the property for safety, security, operational, promotional, and marketing purposes.
By entering the property, you grant Pumpkins Global LLC and its authorized partners permission to photograph, film, record, reproduce, and use your image, appearance, and voice in lawful promotional and operational materials without compensation, unless prohibited by law.
Glowing Pumpkins will not intentionally use a guest’s name in advertising without additional permission.
Security and incident recordings may also be retained or disclosed when reasonably necessary for safety, insurance, legal, or law-enforcement purposes.
Guests are responsible for their own phones, wallets, purses, glasses, clothing, strollers, toys, jewelry, and other belongings.
Pumpkins Global LLC is not responsible for lost, stolen, dropped, or damaged personal property except to the extent liability cannot legally be excluded.
Guests should keep belongings secure and supervise strollers, wagons, and personal items throughout the event.
Glowing Pumpkins is primarily an outdoor event.
Weather, temperatures, wind, rain, dust, and other environmental conditions may affect the event.
Guests should dress appropriately for the weather and wear suitable walking shoes.
Normal weather conditions do not entitle a ticket holder to a refund.
Glowing Pumpkins may temporarily pause, modify, delay, relocate, or close portions of the event when management determines that conditions create a safety concern.
If Glowing Pumpkins cancels an event, available rescheduling or ticket-credit options will be communicated to affected ticket holders.
Glowing Pumpkins may include food vendors, merchandise vendors, entertainment, inflatables, games, activities, or other services provided by independent third parties.
Certain activities may require:
A Glowing Pumpkins admission ticket does not automatically include every activity, product, food item, or service available on the property unless expressly stated in the ticket description.
Displays, entertainment, vendors, activities, operating hours, routes, and event features are subject to change without notice.
Temporary closures, substitutions, shortened operating periods, unavailable vendors, or changes to individual displays or activities do not entitle a ticket holder to a refund.
Glowing Pumpkins may make reasonable changes to the event for safety, operational, weather, staffing, or logistical reasons.
Before beginning formal legal proceedings, the parties agree to make a good-faith effort to resolve any dispute through direct written communication.
To the fullest extent permitted by law, any unresolved dispute arising from these terms, the ticket purchase, attendance at the event, or participation in an event activity shall be resolved through binding individual arbitration administered under the applicable consumer rules of the American Arbitration Association.
BY AGREEING TO ARBITRATION, THE PARTIES WAIVE THE RIGHT TO HAVE THE DISPUTE DECIDED BY A JUDGE OR JURY IN COURT.
Claims must be brought individually and not as part of a class, collective, or representative action, to the fullest extent permitted by law.
Either party may bring an eligible individual claim in small claims court instead of arbitration.
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
For any dispute that is not subject to arbitration, the parties consent to the jurisdiction and venue of the appropriate state or federal courts located in Maricopa County, Arizona.
If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.
The remaining provisions will continue in effect.
By selecting the acceptance checkbox, completing the ticket purchase, accepting or using a ticket, or entering Glowing Pumpkins, you acknowledge that:
